UK Renters’ Rights Legislation 2026: What Landlords Need to Know

From May 2026, major changes to UK renters’ rights legislation will come into effect, bringing new responsibilities and challenges for management agents and landlords across the country. At X1 Sales and Lettings, we are carefully reviewing the legislation and preparing to ramp up communications in the new year to ensure our landlords have the guidance they need to manage their properties confidently.

Key Changes to Legislation (Phase 1)

The changes to the legislation will be rolled out in phases. The first major updates, coming into force from 1 May 2026, include:

  1. End of ‘no-fault’ evictions (Section 21 abolished): Landlords will no longer be able to evict tenants simply by serving a Section 21 notice without giving a reason.

  2. Fixed-term tenancies replaced: These will be replaced with open-ended periodic tenancies.

  3. Rent increases limited: Landlords will only be able to increase rent once a year using a statutory procedure (Section 13) and must give at least two months’ written notice. Tenants will have the right to challenge increases that are not in line with market rates.

  4. Rent bidding banned.

  5. Limits on rent in advance: Landlords will not be able to demand more than one month’s rent in advance.

  6. New tenant protections: Tenants will have the right to request pets, and landlords cannot unreasonably refuse such requests. There will also be no discrimination against prospective tenants because they receive benefits or have children (subject to reasonable exceptions).

  7. New processes and enforcement: New statutory forms and notices will be introduced, alongside enhanced enforcement powers and penalties for landlords who do not comply.

Future Changes

Phase 2 (Late 2026 – 2028) Changes include the rollout of the PRS Database and a mandatory Landlord Ombudsman.

Phase 3 (2028 and beyond) Introduction of the Decent Homes Standard, extension of Awaab’s Law, and EPC/energy efficiency reforms.

Local Rental Market Overview

The rental markets across the UK, and specifically within Manchester and Liverpool, remain highly active, with strong demand for a wide range of properties—from apartments to larger homes.

However, the upcoming legislative changes mean management agents and landlords need to be more proactive than ever in mitigating rental property risks. Under the new rules, you cannot begin eviction proceedings based on arrears until a tenant has fallen more than three months behind on their rent—significantly longer than before. This change alone creates a higher risk of prolonged rent arrears, making the need for rent protection insurance more important than ever.

In early 2025, the average unpaid rent owed by tenants in the private rented sector was around £2,237 — up about 23% year-on-year and more than 50% higher than in early 2023. This reflects increasing pressure on tenants and landlords alike. Government data shows about 5% of private renters were currently in rent arrears, with a further 3% reporting they had fallen behind at some point in the previous 12 months — totalling around 8% of private renters affected in 2024–25.
